Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to face human smuggling charges, he was held in federal custody.

In her order, the court pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal proceedings involve conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.

The court, who was hearing his petition to deportation in a federal court, determined that he must now comply with the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
